Donald Trump’s Attorney Thinks Video of the Insurrection is ‘Too Divisive for Trial’

David Schoen, Trump’s new Atlanta-based mob defense attorney, went on Hannity last night to insist that the jurors in the impeachment trial (Senators) do not need to see the video of the riot and attempted coup. It is just too divisive.

This is akin to a defense lawyer telling the judge that she shouldn’t admit the security camera footage of his client robbing the bank because it might upset the jury and they might find him guilty. There are instances where judges will refuse to admit evidence if it inflames the situation more than it informs the jury. This is not that type of case, this is the security footage of the bank robbery scenario and Schoen knows it. That is why he went on Hannity.

Moreover, Schoen believes that the riot had nothing to do with Donald Trump. Perhaps his assertion underlies his position regarding the video because there certainly is video of Trump urging his followers to “fight harder!” while marching up to the Capitol. There is even more video showing his insurrectionists making it very clear that they are Trump’s army, fighting for Trump, that the election was stolen from Trump and that Trump told them to carry out the insurrection. It would seem that Trump had something to do with the riot.

That is tough evidence and maybe that’s why Schoen would prefer to just not have to deal with it.

Anyway, here’s Schoen:

Wow. He isn’t quite as articulate and persuasive as we expected. Schoen is no Johnie Cochran. (RIP) Trump doesn’t have a dream team.

As we said, this is very much akin to our security footage from your local  Mud Lake Bank and Trust.

Right. Puzzling.

Schoen is off to a bad start (from his and Trump’s point of view) but that is to be expected:

It is very tough to represent guilty clients. One does it responsibly while using anything one can, the system depends upon it. But generally, one tries to make arguments that can be made with a straight face. Calling the video “divisive” is an insult. Plotting a coup-attempt, as his client might well have done, is divisive. Overthrowing the U.S. government, as the insurrections might have done, is divisive.

Video putting it all together might be divisive but it would only divide the responsible citizens from the dangerous, which is the entire point of the impeachment.
