Capitol Hill Police Officer Exonerated in Ashli Babbitt Shooting and Conservatives are FURIOUS

The police officer who shot Ashli Babbitt is one of the most endangered men in America. Sadly, this is made even more so by the fact that he was entirely exonerated on Friday of all wrongdoing in the Babbitt matter. We say “sadly” because this is going to result in even more hatred of the Capitol Hill Police and this man in particular, who – if Trump is to be believed, is known to insiders. From our experience in law, it is likely that the man’s identity is known in and around the Capitol.

But he was exonerated by his own department:

The Capitol Police officer who fatally shot Ashli Babbitt outside a door of the U.S. Capitol during the Jan. 6 riot has been formally exonerated after an internal investigation, according to a department memo obtained by NBC News.

The officer, whose name has not been released, opened fire on Babbitt as she and a mob of other Trump supporters tried to forcefully enter the Capitol.

Video of the shooting showed Babbitt in front of a crowd of rioters trying to get through a door leading to where members of Congress were being evacuated on the House side of the building.

The Justice Department announced in April that no charges were being brought against the officer. The exoneration by the Capitol Police wraps up the last remaining investigation into the incident.

A memo from the commander of the Capitol Police’s Office of Personal Responsibility says “no further action will be taken in this matter on the use of force.”

Obviously, the department has to be careful here because they are being sued and need to worry about any admission impacting their on liability. But if one put us in the officer’s shoes, one would much rather have a release that state, “there were issues that are still be looked at” with a letter in the file saying that the statement was made solely to protect his safety.

We have no doubt that the officer did the right thing. It is an open question as to whether putting this statement out now is the “right thing.”
