Compared to the Florida files case and the Fulton county case (My god, we’re breaking down possible criminal cases against a former president by bunches), the January 6th case looks “messy” and complex.
On the other hand, we don’t know what DOJ knows from people who may have cut deals, ahem “Mark Meadows,” which could simplify things. Additionally, most people would say that the January 6th case is the most severe crime. After all – he attempted a coup. But there is still a chance that the Florida files could be an even more extreme crime depending upon what Trump stole, why he stole it, and what he possibly did with them. If Trump gave nuclear secrets possessed only by the United States and spread them to Russia and-or Saudi Arabia, it could be considered even more traitorous. Look at where we are.
With respect to January 6th, we know that we’re farther down the road than two days ago. From the New York Times [1], which has a copy of DOJ’s new subpoena, and it’s a big one:
“Federal prosecutors investigating the role that former President Donald J. Trump and his allies played in the events leading up to the Jan. 6, 2021, attack on the Capitol have issued a grand jury subpoena to the National Archives for all the documents the agency provided to a parallel House select committee inquiry.
“The subpoena, issued to the National Archives in May, made a sweeping demand for ‘all materials, in whatever form’ that the archives had given to the Jan. 6 House committee. Those materials included records from the files of Mr. Trump’s top aides, his daily schedule and phone logs and a draft text of the president’s speech that preceded the riot.
“Asking the National Archives for any White House documents pertaining to the events surrounding Jan. 6 was one of the first major steps the House panel took in its investigation. And the grand jury subpoena suggests that the Justice Department has not only been following the committee’s lead in pursuing its inquiry, but also that prosecutors believe evidence of a crime may exist in the White House documents the archives turned over to the House panel.”
Well, we know that the House panel has been setting out a criminal case from the very beginning, going element by element on various charges. If DOJ does the same – possibly with more evidence, it could result in charges. It is a very difficult time. Look at the MAGA response to the search warrant. Imagine charging Trump for January 6th. Imagine NOT charging a guy who attempted a coup.
