Trump Lawyer’s Private Audio Recordings Could Be the Final Nail in Trump’s Coffin

Legal experts now say there could be significant evidence in a batch of transcriptions of personal audio recordings that a judge has ordered one of Donald Trump’s lawyers to turn over as part of the ongoing classified documents investigation, Newsweek reports.

Wednesday a three-judge panel at the D.C. Court of Appeals ordered Trump’s defense attorney Evan Corcoran to testify in front of a grand jury and turn over several documents to special investigators on Special Counsel Jack Smith’s team.

The order comes after D.C. District Court Judge Beryl Howell supported prosecutors’ allegations that Trump may have used Corcoran’s to carry out something illegal. In court filings, Howell noted Corcoran could be made to answer questions under oath while citing a clause called the crime-fraud exception. This means that attorney-client privilege, which is usually protected, can’t be invoked if a lawyer and their client are trying to cover up or are engaging in a crime.

This isn’t the first time Corcoran has testified in front of the classified document grand jury, but he had previously refused to answer some questions while citing attorney-client privilege.

This decision coincides with the possible indictment Trump is facing as part of the Stormy Daniels hush payment probe in New York. If he is indicted this means he’ll be the first president in U.S. history to be arrested.

ABC News reported earlier that Howell had previously written in sealed filings that Trump could have deliberately misled Corcoran about retaining the classified materials and ordered him to hand over numerous documents, including handwritten notes and transcriptions of personal audio recordings, Newsweek reports.

And now, more than a few legal experts are saying this means there could be “damning evidence” in the audio records that Corcoran has now been forced to hand over to prosecutors.

“You can’t get better evidence than a defendant’s attorney’s file,” attorney Andrew Lieb of the Lieb at Law firm told Newsweek. “Defendants have to be candid with their attorney so their attorney can do their job.”

“If there is smoking gun evidence that will convict Trump, Corcoran has it, and the fact that an appellate court panel applied the Crime Fraud Exception to Privilege in a matter of hours, after reviewing that smoking gun evidence, indicates that we are in for a doozy on this one.”

In a tweet, former U.S. Attorney Harry Litman tweeted:

“Not to get too breathless or ahead of myself, but Howell ordered Corcoran to turn over materials inc ‘transcriptions of personal audio recordings.’ Think about what those transcriptions could reveal about an apparently unaware Trump. Could be the smoking gun that brings him down.”

Laurence Tribe, professor emeritus of constitutional law at Harvard University, gives us even more reason to hope this is true, writing:

“The Corcoran evidence seems likely to be the straw that breaks this elephant’s back.”

Tristan Snell, a lawyer, and a former assistant attorney general for New York state raised one important point and a few questions.

“Michael Cohen was Trump’s lawyer—and he secretly made audio recordings of Trump,” he said. “Evan Corcoran was Trump’s lawyer—did he also secretly make audio recordings of Trump? That’s what may finally bring Trump down—the RECEIPTS.”

And, he added there are “three really big questions” that Corcoran’s evidence may well answer.

“Did Evan Corcoran record his conversations with Trump? Do Evan Corcoran’s notes and transcripts have smoking-gun evidence that Trump intentionally hid the records? Does Evan Corcoran know where the other missing classified records are?”

Hopefully, more evidence will come out of this. It’s good news that Corcoran will probably be testifying again and can’t hide behind the law this time. Maybe this will be what finally brings down a man who nearly destroyed the country.

That wouldn’t be bad news at all.
