Harvard Law Professor Thinks Trump Should ‘Plead Insanity’ If He Goes to Trial

In a Twitter post, Harvard law professor Laurence Tribe said he thinks Donald Trump should “plead insanity” if he is indicted for events surrounding January 6, 2021’s attack on the U.S. Capitol.

“If this is the ‘defense’ at Trump’s forthcoming trial, I don’t envy the lawyers who agree to represent him. They’d better be psychiatrists expert at reflexive projection and capable of getting their client to plead insanity,” Tribe posted on Twitter, according to Newsweek.

Tribe was responding to Trump’s reaction to the report that was released by the House Select Committee in charge of investigating the failed insurrection, which led a mob of Trump supporters to storm the Capitol in an attempt to overturn the certification of Joe Biden’s Electoral College victory.

In the report, the committee decided that the “central cause of January 6th was one man, former President Donald Trump, whom many others followed. None of the events of January 6th would have happened without him.”

Trump, as is typical, criticized the 845-page report, describing it as a “highly partisan” political “witch hunt.” He once again trotted out his baseless claims of extensive voter fraud during the 2020 election, which, according to him, is the cause of “the protest.”

He also blamed House Speaker Nancy Pelosi, claiming she had ignored his “recommendations for troops to be used,” as the insurrection unfolded.

“The highly partisan Unselect Committee Report purposely fails to mention the failure of Pelosi to heed my recommendation for troops to be used in D.C., show the Peacefully and Patrioticly’ [sic] words I used, or study the reason for the protest, Election Fraud,” Trump complained on Truth Social. “WITCH HUNT!”

Trump and some of his allies have repeatedly echoed claims that troops were requested to protect the Capitol building that day, but a fact check by Politifact and Newsweek found there were no records showing he had made such a request. And some within the former Trump administration say they have never heard the former president make the request either.  There’s also no evidence to suggest that Pelosi turned down the purported request.

And of course, last week the House committee recommended referring Trump to the Department of Justice on four criminal charges related to the attack, and one of those charges includes inciting an insurrection. In an earlier story, I reported that the noted former federal prosecutor, Glenn Kirschner said it was crucial for Trump to be prosecuted for inciting the insurrection because it would prevent him from holding office ever again.

There’s still a very good chance that the ex-president may be charged in another infamous DOJ investigation that’s looking into his alleged mishandling of top-secret documents, which were recovered by the FBI at Mar-a-Lago last August. As Trump always does, he’s playing the victim and claiming he did nothing wrong. Even to the point of bizarrely claiming he somehow declassified the documents before he left office.

And he was in complain mode over this on Truth Social last week.

“Our Country is SICK inside, very much like a person dying of Cancer. The Crooked FBI, the so-called Department of ‘Justice,’ and ‘Intelligence,’ all parts of the Democrat Party and System, is the Cancer. These Weaponized Thugs and Tyrants must be dealt with, or our once great and beautiful Country will die!!!”

But apparently, one post wasn’t enough for Trump (it never is) because he also wrote this last week:

“THEY ARE GOING AFTER ME BECAUSE THEY ARE REALLY GOING AFTER YOU!”

That’s a nice fantasy. I don’t know if any of you have felt like this, but really, when he became president, I continually felt attacked.
