Election 2020

Looks Like Fani Willis Just Found Someone Else to Flip on Trump — And it’s Really, Really Bad for Trump

There may be more bad news for Donald Trump because it looks like another defendant charged alongside him over efforts to overturn his 2020 election loss in Georgia may be ready to flip on him.

Jeffrey Clark, a former U.S. Department of Justice lawyer, is among 18 people charged with Trump as part of an exhaustive indictment that accuses them of violating Georgia’s anti-racketeering law.

Fani Willis, Fulton County’s tough-as-nails District Attorney has secured guilty pleas from four of the defendants in a series of plea deals that commit them to testifying truthfully in upcoming trials regarding the case. Trump and the others charged in the case have pleaded not guilty.

Clark already has plenty of company. Attorneys Jenna Ellis, Sidney Powell, and Kenneth Chesebro have all chosen to accept responsibility for their actions rather than take the risk of appearing before a jury. One lower-profile defendant in the case, bail bondsman Scott Graham Hall, also pleaded guilty to numerous misdemeanor charges in September.

And it’s beginning to look like Clark may be next, Harry Litman, a former U.S. attorney and deputy assistant attorney general says.

Per the indictment, Clark drafted a letter to Georgia state officials that falsely asserted the DOJ “identified significant concerns” that may have affected election results in the state. The former DOJ official wanted the letter sent, but his superiors at the department refused.

Last year, authorities from the District of Columbia Bar charged Clark with allegedly trying to “engage in conduct involving dishonesty” and attempting actions “that would seriously interfere with the administration of justice.”

Clark will face attorney disciplinary proceedings in January, per Newsweek.

Litman noted the proceedings “could have an effect on the dynamic in Fulton County,” in a post on X.

Ellis, Powell, and Chesebro simplified their situations and “all structured their pleas to minimize the collateral risk of losing licenses to practice,” Litman posted. “Now that Clark is facing same, he may be looking to cut a deal w/Fani Willis’s office.”

Some legal analysts are also suggesting that John Eastman, another of Trump’s seemingly numerous former lawyers may also decide to cooperate against the ex-president in a criminal case.

Liz Harrington, a spokeswoman for the former president said he was left “confused” by the trio of guilty pleas from his former lawyers. Harrington added that Trump is “not really bothered by it because he knows he did nothing wrong and we’re gonna win.” That’s weirdly optimistic when you consider that Ellis, Powell, and Chesebro have all entered guilty pleas, meaning they understand their collective gooses may well be cooked.

Harry MacDougald, an attorney for Clark, said last September that Clark was acting within the purview of his official duties when he wrote that letter, the Associated Press reports.

The AP also reports Clark was identified as one of six unnamed co-conspirators in another indictment, this one filed in August by special counsel Jack Smith. The indictment charges Trump with attempting to illegally overturn the results of the 2020 election. He has yet to be charged in that case.

It’s encouraging to see that Willis has lined up these guilty pleas and I hope Clark and more of the other defendants will also make additional plea deals. The more evidence we have against the former carpetbagger-in-chief, the better.
