Texas Agriculture Commissioner Sid Miller cares deeply about what the workers for the Texas Ag Department wear. No, he isn’t interested in safety clothing for the field and no, he’s not interested in professional dress in the offices, his concern is that the right people wear heels and the right people wear cowboy boots.

Yes, in Texas’s never-ending pursuit of hating on the trans population (trans teens are the demographic most susceptible to suicide and so it is heartbreaking to hear increasing hatred toward the group), the Texas AGRICULTURE DEPARTMENT has drawn a line in the sand.

But according to the Texas Tribune:

The two-page policy applies to all employees for the agency that Miller leads, the Texas Department of Agriculture, as well as interns and contract employees. If anyone violates the policy, they will be asked to go home and change. If problems persist, the memo says, employees can face “remedies up to and including termination.”

Is Miller just planning on eye-balling this thing or do they have a genetic machine that can run chromosomal checks almost instantly? It doesn’t matter to the ACLU. They oppose it in any form as they should. The First Amendment covers freedom of association which covers expression and appearing how you want.

Brian Klosterboer, an attorney with the ACLU of Texas, said this dress code provision violates Title VII — which bans employment discrimination based on sexual orientation or gender identity — as well as the First Amendment’s right to free expression and the Equal Protection Clause.

“State agencies should be focused on doing their jobs and not discriminating against their own employees and trying to make political statements through their agency regulations,” he said. “There is no important governmental interest that this can meet.”

Yes, one would normally believe that getting the job done is job one, no matter how dressed. But this is Texas.
